Siding with federal prosecutors, [U.S. District Judge Jeremy] Fogel said the severity of the charges against Abdhir and evidence linking him to aiding his brother, a wanted international terrorist, made it too risky to release him into the community. U.S. Magistrate Judge Howard Lloyd had previously found that Abdhir's ties to his wife and children and others were sufficient to release him, but Fogel said "there are no conditions or combinations of conditions that reasonably will assure the safety of the community." ...Previous Abdhir blogging here and here.Fogel, however, said e-mail exchanges were "clear and convincing evidence" that Abdhir knew his brother was a suspected terrorist involved in violent acts in the Philippines. "It defies common sense to believe that defendant did not know that such assistance was illegal and exposed him to severe criminal penalties," the judge wrote, citing e-mails and other materials seized by the government.
